1. Who you are agreeing with

These Terms are an agreement between you and ⬜ [legal entity name], ⬜ [registered address] ("DecadeShot", "we", "us").

They cover the DecadeShot Android app, the DecadeShot iOS app and the website at decadeshot.com (together, the "Service").

By generating a picture you accept these Terms and the Privacy Policy.

There is no separate signup; the tap on Generate is the agreement, and before your first generation you are shown the confirmation described in §3.

2. What the Service does

You choose a photo and a style. We send that photo, together with a text prompt describing the style, to a third-party AI image provider, which produces one or more new pictures. We give you the results and keep them available to you for 24 hours.

The results are AI-generated images. They are not photographs of anything that happened. They are an imagined picture built from your photo and a description; details will differ from reality, and sometimes they will differ a lot.

3. Age, and whose photo it is

You must be 18 or over to use the Service. If you are not, do not use it.

Before your first generation you confirm two things, and by continuing to use the Service you confirm them again each time:

1. You are 18 or over.
2. The photo is of you, or you have the permission of every person in it.

You must not upload:

• a photo of anyone under 18 — including your own childhood photographs;
• a photo of another person who has not agreed to it;
• a photo you do not have the rights to use.

We record the version of this confirmation and when you gave it. If we have reason to believe a confirmation was false, we may refuse service and remove the results.

4. What you may not do

Do not use the Service to create or share:

• images that impersonate a real person, or that could be mistaken for a genuine photograph of a real person or a real event — including public figures;
• sexual or sexualised content, or content sexualising any person;
• content that is hateful, harassing, defamatory, violent or threatening;
• content that is unlawful where you are, or that infringes someone else's rights;
• misleading content presented as a real photograph, in news, politics, advertising or any other context where someone would be deceived.

Do not attempt to break, overload, scrape or reverse-engineer the Service, to bypass credit limits or the free-credit limits, or to use it through an automated client.

We may refuse, remove or reverse any generation that breaks these rules, and we may stop serving an installation that does so repeatedly. The Service includes a Report control on every result; we act on reports.

5. Your pictures are yours

We claim no ownership of the photo you upload or of the pictures we make for you. They are yours to keep, post and print, including commercially, subject to §4 and to the rules of whatever platform you post them on.

We do not use your photo, your prompt or your results to train, fine-tune or evaluate any model, and we do not use them to promote the app.

You grant us only the permission we need to run the Service: to process your photo for the duration of one generation, to send it to the image provider that produces your picture, and to store the results for the 24 hours they remain available.

⬜ Owner note: we do not control what an AI image provider does with an image after it has answered, and we do not currently hold written non-training commitments from them. The Privacy Policy §5.1 carries the same note. Do not promise on their behalf.

6. Credits

• One standard generation costs one credit. Higher quality tiers cost more credits; the cost is shown before you generate.
• If every image provider fails, the credit is refunded automatically. You do not need to ask.
• New installations receive a small number of free credits. Free and promotional credits may be limited per installation and per network, may expire, and may be withdrawn if they are being farmed.
• Credits have no cash value, cannot be exchanged for money, cannot be transferred to another person, and are not refundable once spent on a generation that succeeded — including a generation whose result you did not like. We may refuse a generation that would break §4 before the credit is spent.
• Your credit balance is held against the random device identifier described in the Privacy Policy §3.1. On Android, deleting the app loses that identifier — tap Restore purchases after reinstalling and the credits you paid for will move to the new installation. Free and promotional credits do not move.
• We keep a ledger of every change to your balance. If you think a balance is wrong, write to us with the device identifier shown on the Settings screen.

7. Purchases, subscriptions and refunds

Credits and the Pro subscription are sold by Google Play, Apple or Paddle — not by us directly. The price you are charged is the store's localised price, shown to you before you confirm.

Pro is an auto-renewing subscription. It renews at the end of each period through your store account until you cancel. You cancel it in your Google Play or Apple account, not in the app. Pro grants a set number of credits per period; unused credits in a period do not roll over.

Refunds are handled by the store that sold you the purchase — Google Play, Apple or Paddle — under that store's own policy. We cannot issue a refund for a store purchase ourselves. If a store reverses a purchase, we reverse the corresponding credits; this can leave your balance negative, and generation is blocked until the balance is back above zero.

If your statutory consumer rights where you live give you more than the store's policy does, those rights apply and nothing here limits them.

8. Availability, and the 24-hour rule

Every picture we make is deleted 24 hours after it is made. This is a privacy feature, not a storage limit, and it applies to share links too. Save anything you want to keep.

The Service is provided as is and as available. We may change, suspend or stop any part of it, including styles, quality tiers and prices. We do not promise that any particular style, image provider or result will be available at any particular time.

9. Liability

To the fullest extent the law allows:

• We are not liable for indirect, incidental, special or consequential loss, or for lost profits, lost data or lost pictures — including a picture you did not save before it was deleted.
• Our total liability to you, for all claims, is limited to the amount you actually paid us in the twelve months before the claim arose.

Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud, or for your non-excludable statutory consumer rights.

10. Indemnity

You are responsible for the photos you upload and for what you do with the results. If someone brings a claim against us because of a photo you uploaded or an image you created or shared, you agree to cover our reasonable costs of dealing with it — except to the extent the claim arises from our own breach of these Terms.

11. Ending

You can stop at any time by deleting the app or leaving the website. Unused credits are not refunded when you stop.

We may suspend or end your access if you break these Terms, if we are required to by law, or if we stop offering the Service. If we end your access without cause, ⬜ [decide: we will refund unused paid credits / we will not refund unused credits].

12. Changes

We may update these Terms. The date at the top changes, and for a material change we raise the in-app consent version, which means you will be asked to confirm the new Terms before your next generation. If you do not accept them, stop using the Service.

13. Governing law, and disputes

These Terms are governed by the law of ⬜ [governing law — e.g. Singapore / India / England and Wales], without regard to conflict-of-law rules.

Any dispute will be subject to the exclusive jurisdiction of the courts of ⬜ [jurisdiction], except that a consumer may also bring a claim in the courts of their own country of residence where their local law gives them that right.

⬜ Owner decision, and it is not cosmetic: this should match where the operating entity is registered and where its bank is. Naming a jurisdiction the entity has no connection to is worse than naming none.

14. The rest

• If a provision is unenforceable, the rest stays in force.
• Our not enforcing a provision at one time does not waive it.
• These Terms, together with the Privacy Policy, are the whole agreement between us about the Service.
• You may not transfer your rights under these Terms. We may transfer ours to a successor of the business, on notice.
• Apple-specific: these Terms are between you and us, not Apple. Apple is not responsible for the Service or for support of it, has no warranty obligation in respect of it, and is a third-party beneficiary of these Terms with the right to enforce them against you.
